Frequently Asked Questions
- Are you a lawyer? No. My knowledge is gained from experience of assisting others through the family law Courts regularly over many years. I have my own personal experience of tackling issues, I understand because I have been there.
- Do you have access to legal authorities, books, research & latest case law?Yes. I have similar resources to what many lawyers have and more than some.
- What are you going to Cost?£40 per hour. See Costs and Fees for further details.
- Will you be allowed in Court with me?Yes, almost certainly. There are rare occasions where a McKenzie Friend may be refused entry to the Court but it will be highly unlikely. As a McKenzie Friend I will sit next to you in Court providing quiet advice and support as necessary.
- Can you represent me at Court and speak for me?Only at the discretion of the Court. This is termed 'Rights of Audience' and has to be permitted by the Judge. Regularly people I assist are granted permission for their McKenzie Friend to have ROA but this does depend on the individual Judge and the circumstances of the case.
- I am nervous, mutter and stumble over my words when in Court, can you help? I can help by providing written notes in Court and talking quietly to you when necessary to remind you of points you wanted to make. Most people are nervous; particularly the first time by themselves but I will keep you focussed and support you. At their discretion the Court may give permission for your McKenzie Friend to speak on your behalf.
- Can you help me with my statement and other documents for Court?Yes, I can assist you in drafting documents such as statements. I can produce skeleton arguments and submissions for example which may reference relevant case law and other authorities. Judges (including a Circuit Judge QC and Lord Justice's) have commented positively on the excellent submissions submitted.
- Can I arrange a meeting with you to discuss my case?Yes. I offer a free 30 minute telephone/email initial discussion or you can meet me in Bookham, Surrey (near the M25 where the A3 crosses), the first 30 minutes are free. I can travel to you for a meeting but there will be a cost of £40 per hour (including travelling time).
- I want to limit or stop the other parent spending time with our children, will you help me?No (generally). I passionately believe in doing what is best for children. Research supports the view that shared parenting or near is best for children. Unless there are proven or likely to be proven risks of harm to children I will not assist in limiting or stopping children's time with another parent. See the Children page for further explanation of shared parenting.
